1.1) Terms ‘‘HYPE-R’’, ‘‘we’’, ‘‘our’’ and ‘‘us’’ refer to the brand HYPE-R and its parent company.
1.2) Sites located at .hype-r.eu are providing information about the products and services that we offer.
1.3) You must agree to these Terms to use the Site. By accessing or using the Site, you agree to these Terms and the processing of your personal information in accordance with the HYPE-R Privacy Policy. If you do not agree to these Terms or the HYPE-R Privacy Policy, do not use the Site. HYPE-R may periodically update or modify these Terms. The date of the most recent changes to these Terms is provided in these Terms. It is your responsibility to regularly review these Terms. By continuing to use the Site after changes to these Terms, you are indicating that you agree to the modified Terms.
2. hype-r’s content
2.1) All: trademarks, text, images (including logos), animated images, videos, artwork, sounds, user interfaces, computer code and visual interfaces (collectively “HYPE-R’s content) including design, look and feel and coordination of HYPE-R content is owned, licensed or controlled by HYPE-R or it’s authors and is protected by national and international laws on intellectual property as well as national and international laws on unfair competition.
One can not use any of the above stated content (even as hidden content) without an explicit permission, in a written form, originating from HYPE-R brand or it’s parent company (which needs to be proven by stamp and signature).2.2) No data from the Site and no HYPE-R’s content may be copied in any way fully or partially for any kind of use or distribution without the consent afore mentioned in ‘‘2.1’’ and proven as it states.
One may use information about HYPE-R’s products (which includes product specifications, product manuals and similar materials) that HYPE-R makes available for download from the Site but only if they:
a) Do not change any information or looks in the document including the name of the document and metadata
b) Use the specified information only for Non-commercial use or doing business with HYPE-R or it’s affiliated businesses
c) Do not copy or post specified information and documents on the internet or publish it in any media.
3. use of the site
3.1) One may not try to breach any password locked part of the Site or obtain any information about HYPE-R by any reverse engineering, hacking, password mining, brute force or any other unauthorized means.
3.2) One may not try to penetrate or in any other ways test the security of the Site or any network connected to the Site without a consent mentioned in 2.1.
3.3) Additionally, one may not take or partake any action aimed at or resulting in putting a large load of traffic on our Site or any other part of our infrastructure as well as interfere or attempt to interfere with the functioning of this Site.
4. User accounts
4.1) One may register for and use HYPE-R user account on the Site only if they attained the age of legal majority in their jurisdiction. Otherwise one must have a parent or a legal guardian register for and control the account for them.
4.2) One may not register for or use a HYPE-R user account if they have previously been banned from doing so by HYPE-R or one of it’s representatives.
4.3) HYPE-R keeps the right to refuse granting one with a particular user account name or ID for any reason that it sees fit. All of the accounts on the Site are the property of HYPE-R and we keep the right to close them or cancel their making at any time and for any reason.
4.4) When one is creating a user account they may be asked to provide their name, phone number and other personal information. You agree to maintain up to date, complete and accurate information in your user account. 4.5) It is your responsibility to keep your password confidential and your Account secure. You agree you are solely responsible for all activity and purchases that occur through your Account. You agree to notify HYPE-R immediately of any unauthorized use, or suspected unauthorized use, of your Account and any other breach of security. Letting a banned user use your account is strictly forbidden.
4.6) HYPE-R is not liable for any loss or damage arising from your failure to comply with the above requirements or from any losses resulting from unauthorized access to or use of your Account or the Site and not only that, but you may be liable to HYPE-R or third parties for such unauthorized access or use.
5. Third parties
5.1) In some cases, HYPE-R may, through the site, provide services or facilitate your connection to independent third party providers of goods and services related to or unrelated to the HYPE-R brand, which can include, but is not limited to: HYPE-R vehicles sub distributors, HYPE-R vehicles maintenance shops, financing providers or payment processors (‘‘Third Party Providers’’) HYPE-R can not be held liable or responsible for any potential damages or inconveniences that occur or arise from the side of or because of Third Party Providers. You should always read the Terms and Agreements and Privacy Policies of the Third Party Providers before engaging with them or using their services.
6. Limitation of liability
6.1) IN NO EVENT SHALL HYPE-R BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL, EXEMPLARY OR CONSEQUENTIAL, DAMAGES, OR ANY DAMAGES WHATSOEVER, EVEN IF HYPE-R HAS BEEN PREVIOUSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, WHETHER IN AN ACTION UNDER CONTRACT, NEGLIGENCE, OR ANY OTHER THEORY, ARISING OUT OF OR IN CONNECTION WITH THE USE, INABILITY TO USE, OR PERFORMANCE OF THE INFORMATION, SERVICES, PRODUCTS, AND MATERIALS AVAILABLE FROM THE SITES. THESE LIMITATIONS SHALL APPLY NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY.
If this limitation of liability is held to be unenforceable, HYPE-R’s maximum liability to you shall not exceed the amount you paid to HYPE-R for the products or services giving rise to your claim. Some jurisdictions do not allow the limitation or exclusion of liability for certain damages, so the above limitations and exclusions may not apply to you. These Terms do not require you to waive any rights, where such waiver is prohibited by applicable law.
7. miscellaneous
7.1) The paragraph headings in these Terms are only for convenience and have no legal effect. No waiver by HYPE-R of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of HYPE-R to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
